Music reporting of performed Music
The Licensee shall report music as set out in the General Terms and Conditions. The obligation to report music
always applies when Music has been performed by artists who are not resident in Sweden and for performances of art music (orchestral music, chamber music, etc.). The Licensee also has an obligation to report Music performed by Swedish artists at Stim's request in the cases specified below.
Popular music, jazz and folk music performed by Swedish artists is usually reported by the artists, their representatives or by Stim and the Licensee then has no obligation to provide further compilation unless Stim specifically requests it.
Other
Advance notification
If Stim so requests, the Licensee is obliged to notify Stim of planned events in advance. Notification must be submitted at least seven calendar days before the planned event and must contain information on date, venue and location. For Live Music the names of the artists to perform must also be provided.
Visits
Stim has the right to visit events in order to verify that the Licensee submits correct information on Reporting and Music reporting. Stim shall announce visits in advance and the Licensee shall then provide two entrance tickets free of charge.
Hiring out premises and responsible organiser
If a Licensee makes premises available to a third party who uses Music in a way that triggers licensing obligations (a so-called responsible organiser), the responsible organiser shall normally take out a license and assume the obligations that thereby arise. The Licensee shall inform Stim that a responsible organiser has used the premises and state the date of the letting. The Licensee shall also inform the responsible organiser that they may need to enter into a License with Stim and assume the obligations that thereby arise. If the responsible organiser does not take out a license when required, the Licensee may be regarded as responsible for the music use.
By responsible organiser is primarily meant the person who has a permit according to the Public Order Act or a permit for the sale of food or alcohol on the premises. Secondly it means the person in whose cash book the ticket revenues are recorded. Independent ticket agents are not considered responsible organisers if the majority of ticket revenues are credited to someone else. For free-entry events the person who has the financial accounting responsibility for the majority of the costs is considered the Responsible organiser.
